Merchandise terms and conditions

Booking – an advance reservation for a Hire of any The University of Edinburgh Sport Service

Facilities – premises belonging to (and/or equipment provided by) The University of Edinburgh Sport

Merchandise – all items and products available for sale or Hire by The University of Edinburgh Sport

Hire - the temporary use of equipment by a User from The University of Edinburgh Sport

Hire Fee – A payment to The University of Edinburgh Sport by a user for equipment Hire which must be paid in full prior to the Hire period 

Users – Anyone taking part in a Booking in the Facilities 

1.1. The University of Edinburgh Sport will refund or exchange Merchandise purchased from The University of Edinburgh Sport, where the Merchandise is returned unopened and unused, within 30 days of purchase and with proof of purchase.  

1.2. Under no circumstances will water bottles food, drink, perishable items or towels be refunded or exchanged. 

1.3. The University of Edinburgh Sport accepts no responsibility for faults to Merchandise caused by accident, neglect, misuse or normal wear and tear. Where the purchaser believes that their item of Merchandise is faulty, they may contact a member of The University of Edinburgh Sport staff to discuss the matter further with them.

1.4. The manufacturer’s terms and conditions of any merchandise supplied by a third party will supersede this agreement.  

1.5. The University of Edinburgh Sport reserves the right to offer promotions or discounts on all Merchandise at any time. Offers are valid for the duration specified in the offer. The University of Edinburgh Sport reserves the right to change or cancel promotions or discounts at any time.

2.1. The University of Edinburgh Sport charges a Hire Fee for the Hire of selected equipment. The equipment available and the Hire Fee are available on request and where possible displayed in the Facility  

2.2. The University of Edinburgh Sport reserves the right to vary the Hire Fees or to offer promotions or discounts. Offers are valid for the duration specified in the offer. The University of Edinburgh Sport reserves the right to change or cancel promotions or discounts at any time.  

2.3. The User will use the Hire equipment in a good and careful manner 

2.4. The University of Edinburgh Sport may request a Security Deposit, such as a student card or driving licence, as well as a Hire Fee, prior to the start of the Hire period, which is returned when the Hire period ends and equipment returned in good condition 

2.5. The University of Edinburgh Sport reserves the right to refuse a Hire to any User. 

2.6. To the extent permitted by law the user will be responsible for the loss, theft, damage or destruction of the Hire equipment 

3.1. The University of Edinburgh Sport does not exclude or limit in any way its liability where it would be unlawful to do so. This includes liability for death or personal injury caused by the negligence of The University of Edinburgh Sport or our staff.

3.2. Subject to the above, the use of the Facilities and Hire Equipment is at your own risk. Users must not use any equipment or undertake any activity unless satisfied that they are competent to do so safely and properly. Members are under a duty to safeguard their own health and safety and that of others whilst using the Facilities and Hire Equipment. The University of Edinburgh Sport will not be responsible for any harm or injury that is attributable to the Member’s own fault, for example unsafe use of the Facilities or failure to advise staff of a medical condition relevant to such use.
